The Terms and Conditions of Sales: The buyer accepts the terms and conditions of sales hereafter.
1. Product Nature:
1.1 For the stock products, please preview the technique information maybe applied such as (1) Particle size test determined by (i) TEM or （ii）SEM micrograph or （iii） laser or （iv）meshing, (2) XRD pattern for materials phase determination, (3) BET for SSA, (4) Chemicals/impurities etc. on the COA, for powder product and other technique documents at seller’s website (cerametek.com) or in the quotation before you place a purchase order for your proper options.
1.2 For the customized sample products, please describe all the requirements including chemical formula, impurities, particle size and other specifications, packaging condition etc. on the enquiry and purchase order.
2. Price and Payment:
2.1 The listed price is FOB Cerametek Warehouse in Beijing and does not include shipping costs, brokerage fee, insurance, tax, duty, inspection fee by authority or other service etc..
2.2 The payment on the proforma invoice for the international buyer is in USD, based on the CHN value at the exchange rate of quotation date or paying date, and needs to be wired to the seller business bank account in advance or with your institutional purchase order,. All the payment needs to be cleared before shipping.
2.3 The seller reserves the right to change the quoted price of the product sensitive to the market until this raw material is in stock before production.
3. Shipping & Handling：
3.1 The prepaid S&H fee on the invoice include (i) freight cost (door to door, usually), (ii) the insurance cost etc. during shipping.
3.2 The S&H fee will be voided for freight collect by your contract shipping service (such as EMS, FedEx, UPS, DHL) available at the factory point or charged for the domestic party when the collect occurred at the another destination in China.
3.3 Hazards handling: the dangerous goods shipped are subjected the special handling fee that will be charged to the buyer on the invoice.
3.4 Buyer will accept the terms and condition of shipping service. All the risks during shipping will be covered by the insurance.
3.5 For safety, to handle the product sold needs to wear protective equipments such as safety glasses, mask, glove and working clothing.
4. Tax and fees: The sales tax is included in the FOB price. There is no exemption on the sales tax of chemical materials imposed by the government. Any other costs such as inspection beyond the factory point, customs tax or duty for international customer imposed or charged by the authorities will be directly paid by the buyer.
5. Return policy:
5.1 All the stock product purchased and shipped for return even without test will be charged a restock fee 30%-50% of product price. All the shipping related costs will be paid by the buyer.
5.2 For custom-made items, the cancellation or returning is not allowed. All the returns require the authorization from the seller (refer to warranty provision).
6. Warranty: The seller warrants that its products shall conform, in a reasonable manner, to the specifications on the product label or the specifications required on the purchase order or contract. The seller does not warrant the experiment results in use of the product purchased unless otherwise specified. In case of quality problem, the evidence by a same method as that of the seller is required for returns also with authorization by the seller. The replacement will be arranged or the paid amount for loss will be refunded within 30 days from the date of receiving of goods complained.
7. Penalty for delay: For the delayed amount owed for any reason over one month, the delaying party will add 5% interest for an extra compensation to the losing party.
8. Discounts: The discount (3-5% stated on the invoice) policy is applicable when the buyer and user accept the obligation to feed back via e-mail, within 6 to 12 months, a copy of the test or research results in the form of publication, report or memo on the product ordered. 9. Disputes:
In case any other conflicts, a new agreement accepted by the seller and buyer needs to be reached referring to the China business laws or the international trade laws such as "The Convention of the International Sale of Goods". In case of no agreement reached, the solution made by an international civic court in Beijing or Hongkong or Singapore will be accepted by both parties.
